In August 2020, Epic Games, Inc. initiated a lawsuit against Apple, Inc. for restricting game developers from selling their apps outside of Apple’s app store. This case stands out not only due to the usual issues in competition litigation but also because the lower court ruled against Epic at the federal level while ruling in its favor at the state level on one count. Additionally, the appeals court upheld the lower court’s decision. It is noteworthy that the court is implementing the remedy at the national level, despite the decision being made at the state level.
