In antitrust litigation, witnesses play a crucial role by providing factual evidence. Business professionals, including company executives, often testify. Both the plaintiff and defendant may call their business representatives to testify, in addition to those from the opposing side and third parties. These testimonies may describe the dynamics of the relevant market and the business strategies associated with the actions in question. Most importantly, they may reveal the intentions behind these actions and any justifications for the business behaviours exhibited.
