FTC v Southern Glazer and FTC v Pepsi: Price Discrimination
Case Study
In December 2024, the Federal Trade Commission (FTC) filed a complaint against Southern Galzer’s Wine and Spirits, LLC (“Southern”) for violating the Robinson-Patman Act. In January 2025, the FTC also filed a complaint against Pepsico, Inc. (Pepsi) for the same violation. However, on May 22, 2025, the FTC dismissed the complaint against Pepsico. Both complaints highlight instances of price discrimination, which may violate U.S. laws. This sequence of events offers a compelling case study on the nature of these complaints.
